Election Radar Terms of Service

These Terms of Service ("Terms") govern your access to and use of Election Radar, including its mobile applications, content, and related services (collectively, the "Service"). The Service is developed and operated by the Election Radar team ("we," "us," or "our").
By accessing or using the Service, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree to these Terms, you must discontinue use of the Service.
1. Description of the Service
Election Radar helps users discover and follow election-related events and developments across the United States. The Service may provide:
- election-related highlights presented through AI-generated text based on third-party reporting;
- highlights organized by week, state, or category;
- interactive maps and state timelines;
- images and attribution information; and
- links to original reporting and other third-party sources.
The availability, presentation, update frequency, and scope of these features may change over time.
2. Informational Purpose
The Service is provided for general informational and educational purposes. It is not an official source of election results, voting requirements, registration deadlines, candidate filings, ballot information, or government records.
For official election information, users should rely on the appropriate federal, state, or local election authority. Content provided through the Service does not constitute legal, financial, political, or professional advice.
3. AI-Generated Content
The text presented for each highlight is generated using artificial intelligence and automated processing systems based on third-party reporting. Content may subsequently be reviewed, corrected, revised, or updated through automated processing, human-directed review using AI tools, or a combination of these methods.
AI-generated content may contain errors, omissions, outdated information, incomplete context, or inaccurate information. The text for each highlight is intended to provide a brief summary of an election-related event or development. It is not a complete summary of any original source and may omit context, details, qualifications, quotations, or subsequent developments.
Users should consult the linked original sources and other reliable sources before relying on information provided through the Service or making decisions based on it.
4. Editorial Independence and Political Neutrality
Election Radar is independently developed. The Service is not affiliated with, sponsored by, authorized by, or endorsed by any political party, candidate, campaign, political committee, government agency, election authority, or news organization.
The inclusion, exclusion, placement, categorization, wording, revision, or frequency of a highlight does not express an endorsement of or opposition to any person, party, policy, organization, or political position.
5. Third-Party Reporting, Images, and Services
The Service may display or link to news articles, websites, images, trademarks, logos, names, and other materials provided by third parties. These materials remain the property of their respective owners and may be subject to separate copyright, trademark, licensing, privacy, and usage terms.
Election-related events or developments featured as highlights are identified from publicly available third-party reporting, and the text used to present them is generated using artificial intelligence. Links are provided so users can access the original reporting and obtain fuller context.
Some images may be obtained from Wikimedia Commons or other sources that make content available under specific licenses. Attribution and licensing information may be displayed where applicable.
When you open an external link, including through an embedded browser, you are accessing a third-party service. We do not control the availability, accuracy, content, security, privacy practices, advertising, or functionality of third-party services. Your use of those services is governed by their own terms and policies.
6. Limited License
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Service for lawful, personal, and non-commercial purposes.
This license does not transfer ownership of the Service or any content made available through it.
7. Acceptable Use
You agree not to:
- use the Service for unlawful, fraudulent, abusive, or harmful purposes;
- interfere with, disrupt, overload, damage, or impair the Service or its infrastructure;
- bypass or attempt to bypass rate limits, access controls, security measures, or usage restrictions;
- access or attempt to access systems, data, endpoints, or areas of the Service without authorization;
- use automated systems to systematically scrape, extract, download, reproduce, or index substantial portions of the Service;
- copy, republish, sell, license, or commercially redistribute the Service or substantial collections of its content;
- reverse engineer, decompile, disassemble, modify, or attempt to derive the source code of the Service, except where applicable law expressly permits such activity;
- remove or alter copyright notices, source links, license information, trademarks, or attribution; or
- falsely state or imply an affiliation with Election Radar or its team.
We may use technical measures, including rate limiting and access restrictions, to protect the Service and enforce these Terms.
8. Intellectual Property
The Service, including its software, interface design, branding, logos, organization, selection, compilation, and original materials, is owned by us or licensed to us and is protected by applicable intellectual property laws.
Third-party news articles, images, logos, trademarks, and other materials remain owned by their respective rights holders. Nothing in these Terms grants you rights to use third-party materials beyond the permissions provided by the applicable rights holder or license.
9. Service Availability and Changes
We may update, modify, suspend, restrict, or discontinue any part of the Service at any time. News sources, external links, images, summaries of election-related events or developments, translations, categories, timelines, and other content may be added, corrected, replaced, or removed.
The Service may occasionally be unavailable because of maintenance, technical problems, network conditions, security incidents, third-party service interruptions, or circumstances beyond our control.
We do not guarantee that the Service will always be available, uninterrupted, secure, current, complete, or free from errors.
10. Suspension and Termination
We may restrict, suspend, or terminate access to the Service when reasonably necessary to protect the Service, other users, third parties, or our legal rights, including in response to suspected abuse, security threats, unlawful activity, or violations of these Terms.
You may stop using the Service at any time. Provisions that by their nature should survive termination, including intellectual property, disclaimers, and limitations of liability, will remain in effect.
11. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis. We disclaim all warranties, whether express, implied, or statutory, including warranties of accuracy, completeness, timeliness, reliability, merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that AI-generated text describing election-related highlights, election-related information, third-party reporting, images, translations, links, or other materials will be accurate, complete, current, available, or suitable for any particular purpose.
12. Limitation of Liability
To the fullest extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, revenue, opportunity, goodwill, or business arising from or related to:
- your access to, use of, or inability to use the Service;
- errors, omissions, delays, or inaccuracies in AI-generated text or other AI-generated content;
- reliance on summaries of election-related events or developments, translations, categories, timelines, or election-related information;
- third-party websites, reporting, advertisements, services, or content;
- unauthorized access, security incidents, service interruptions, or technical failures; or
- changes to, suspension of, or discontinuation of the Service.
Where liability cannot be excluded under applicable law, our liability will be limited to the greatest extent permitted by that law. Nothing in these Terms limits rights or remedies that cannot lawfully be excluded or restricted.
13. Privacy
Our Privacy Policy explains how information is handled when you use the Service. By using the Service, you acknowledge the practices described in the Privacy Policy.
14. App Store and Platform Terms
If you download or use the Service through the Apple App Store, Google Play, or another distribution platform, your use may also be subject to that platform's applicable terms, rules, and license agreements.
For versions distributed through the Apple App Store, Apple's Standard Licensed Application End User License Agreement may apply unless a separate license agreement is provided. Where required by the applicable platform, its terms will govern matters relating to download, installation, licensing, payment processing, and platform services.
15. Changes to These Terms
We may update these Terms to reflect changes to the Service, our practices, applicable laws, or operational requirements. The updated Terms will display a revised "Last Updated" date.
Your continued use of the Service after updated Terms become effective constitutes acceptance of the updated Terms, to the extent permitted by applicable law.
16. Severability
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will continue in full force and effect.
17. Entire Agreement
These Terms, together with the Privacy Policy and any additional terms presented within the Service, constitute the entire agreement between you and us regarding use of the Service.
